Agreeing to these terms

These terms are the agreement between you and Pegacow for pegacow.com and everything sold on it. By browsing the site or placing an order you accept them. If you don't, please don't use the site. Our Privacy Policy is part of this agreement.

Who can order

You need to be at least 18, or old enough to enter a contract where you live with a parent or guardian's permission, and you need a valid payment method and a U.S. shipping address. We ship to the United States only for now.

Orders and pricing

Prices are in U.S. dollars and are confirmed at checkout. Sales tax is calculated there where it applies. Placing an order is an offer to buy; the contract forms when we confirm the order by email.

We may decline or cancel an order — and will refund you in full if we do — where an item is unavailable, where a price or description was obviously wrong, where payment can't be authorised, or where we suspect fraud or resale. If a mistake in the listed price is clear enough that you'd have spotted it too, a confirmation email doesn't oblige us to honour it.

Everything is made to order

Nothing sits in a warehouse — each piece is printed, framed or packed for you after you order it. Production takes 2–5 business days, then 3–7 business days in transit. Those windows are estimates, not guarantees, and carrier delays are outside our control. U.S. shipping is free on orders over $50; below that it's a flat $4.99.

Risk of loss passes to you on delivery to the address you gave us. If that address is wrong or incomplete and the parcel is lost as a result, we can't replace it for free — so please double-check it at checkout.

Screens differ, and paper isn't a screen: small variation in colour and in how a design sits within the frame is normal and isn't a defect.

Cancellations, returns and refunds

Because each item is made for you, we can't accept returns for a change of mind once production has started. If you need to cancel, email us immediately — we'll cancel and refund in full if the item hasn't gone into production yet.

If your order arrives damaged, defective or misprinted, email moo@pegacow.com within 30 days with a photo and we'll send a free replacement or refund you in full — you won't need to ship anything back. Refunds go back to the original payment method. The full policy lives on the about page.

Designs you create

If you describe a design in the Pegacow studio, you're responsible for what you type. Don't ask for anything that infringes someone's copyright or trademark, uses a real person's name or likeness without permission, or is hateful, sexual or otherwise unlawful. We can refuse to generate or print any design, and refund it, at our discretion.

You give us the permission we need to generate, store, print and ship your design and to keep a copy for order records and support. Generated artwork builds on the Pegacow character, which stays ours — so a design you create is yours to own, hang and gift, but not to resell as merchandise or register as a trademark.

Our artwork and brand

The Pegacow character, the artwork, the name, the logo and the contents of this site belong to us. Buying a print buys you the print: it's for personal, non-commercial use. Reproducing, reselling, printing or redistributing our designs — including scraping the site or its feeds to make products — needs our written permission.

Using the site

Don't try to break, overload or gain unauthorised access to the site, place fraudulent orders, or use automated tools to hammer our endpoints. We may rate-limit, block or refuse service to keep the shop running for everyone else.

Disclaimers and liability

The site is provided as is. We don't warrant that it will be uninterrupted or error-free, and to the extent the law allows we disclaim implied warranties of merchantability and fitness for a particular purpose. Nothing here limits any right you have that can't be limited by law, including under consumer protection statutes.

To the extent the law allows, we aren't liable for indirect, incidental or consequential losses, and our total liability for any order is capped at what you paid for it. That cap is the deal that lets a small shop sell $79 prints; it isn't an attempt to dodge a bad order, which we'll always put right under the policy above.

Governing law and disputes

These terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws rules, and the courts there have exclusive jurisdiction over any dispute. Talk to us first, though — email moo@pegacow.com and we'll almost certainly sort it out without lawyers.

Changes and the fine print

We may update these terms; the version in force for your order is the one published when you placed it, and the effective date at the top tells you when this version took over. If a court finds part of these terms unenforceable, the rest stays in force. Not enforcing something once doesn't waive it. These terms, with the Privacy Policy, are the whole agreement between us.
